These Terms of Service ("Terms") govern your use of the Trade Wind & Co. website () and the catamaran import services described therein. By accessing this site or engaging Trade Wind & Co. ("we," "our," "us," or "the Company") for services, you agree to be bound by these Terms.
1. Who we are
Trade Wind & Co., LLC is a Florida limited liability company operating as a catamaran import service. We assist US buyers in acquiring foreign-built catamarans from Caribbean broker inventory and arrange the survey, acquisition, customs entry, ocean delivery, and US Coast Guard documentation. We act as principal (taking title in the foreign jurisdiction and reselling to the US buyer) under the owner exemption in Florida Statute Chapter 326, or, where applicable, under a Florida Yacht & Ship Broker or Dealer license.
2. Information on this website
Inventory listings, pricing, photos, specifications, and other information displayed on this website are sourced from publicly available source-broker listings and from our own research. We make reasonable efforts to keep this information accurate and current, but:
- Listings, prices, and availability change frequently. All inventory information is "deemed reliable but not guaranteed."
- Specifications, engine hours, and equipment lists are as represented by the source broker and have not been independently verified by Trade Wind & Co. unless we have performed a survey on the specific hull.
- Photos are sourced from the original source broker's listing and are believed to depict the actual vessel, but we cannot guarantee that every photo is current.
- Estimated "US retail comparable" values are market estimates derived from public listings on YachtWorld, Boat Trader, The Multihull Company, and similar sources. They are not appraisals.
- Estimated landed-cost calculations assume current US Customs and Border Protection duty rates (currently 20% on most foreign-built vessels). Tariff rates can change. We update our published rates as we become aware of changes.
3. No agency relationship from website use alone
Browsing this website, submitting an inquiry, or scheduling an inspection does not create an agency relationship between you and Trade Wind & Co. A binding relationship is created only by a written purchase agreement signed by both parties.
4. Inspection process
If you request an inspection, you are responsible for engaging the surveyor directly (we coordinate scheduling and access, but the surveyor's contract, fee, and report belong to you). You bear the cost of the survey, your travel if you choose in-person inspection, and any side expenses you incur. Trade Wind & Co. is not responsible for the surveyor's findings, omissions, or recommendations.
5. Purchase, escrow, and funds handling
Any purchase you make through Trade Wind & Co. is governed by the specific purchase agreement signed between you and the Company. Customer funds are held by an independent third-party maritime escrow agent (Yachtworld Escrow or equivalent), not by Trade Wind & Co. directly. Funds are released to vendors at the milestones specified in the escrow disbursement instructions attached to your purchase agreement. The escrow agent — not Trade Wind & Co. — is the fiduciary of customer funds.
6. Tariff and customs
US Customs and Border Protection duty rates are set by federal statute and regulation and may change with limited notice. We quote based on the rate in effect at the time of acquisition. The customer is informed of the applicable duty calculation at signing. If the rate changes between signing and customs entry, we work with the customer to manage the impact (which may include rescheduling delivery or, if material, adjusting the contract). Sales tax in Florida and destination states is handled per the maritime CPA's structuring guidance and disclosed at signing.
7. Ocean delivery
Ocean delivery is performed by a USCG-licensed independent delivery captain under a separate delivery contract. Trade Wind & Co. coordinates the engagement but is not the carrier. Transit insurance is bound through a marine insurance broker (Pantaenius USA or Markel) for the duration of the passage. Hurricane-window delays, weather routing decisions, and shelter-port decisions rest with the captain in consultation with the insurance carrier.
8. USCG documentation
Post-delivery, US Coast Guard documentation is filed via a third-party documentation service (Maritime Documentation Center or equivalent). The current NVDC processing backlog is 60-90 days. Temporary documentation covers the gap; legal operation of the vessel is not blocked. Trade Wind & Co. is not responsible for NVDC processing times.
9. Limitation of liability
To the maximum extent permitted by law, Trade Wind & Co. is not liable for indirect, incidental, consequential, special, or punitive damages arising out of or relating to your use of this website or the services. Our aggregate liability for any direct damages is limited to the fees actually paid to us under the relevant transaction.
10. Disclaimer of warranties
This website is provided "as is" and "as available." We disclaim all warranties, express or implied, including warranties of merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that information on the website is current, complete, or error-free.
11. Intellectual property
The Trade Wind & Co. name, logo, design, and original content are our property. Boat photographs are hotlinked from the original source-broker listings and remain the property of their respective copyright holders. You may not reproduce, distribute, or display this content for commercial purposes without our express written permission.

This website links to third-party sites (source brokers, US Customs, USCG, etc.) for your convenience. We do not control those sites and are not responsible for their content or practices.
13. Governing law
These Terms are governed by the laws of the State of Florida, without regard to its conflict-of-laws principles. Any dispute arising from or related to these Terms or the services shall be resolved exclusively in the state or federal courts located in Miami-Dade County, Florida.
14. Changes to these Terms
We may modify these Terms from time to time. Material changes will be flagged with an updated "Last updated" date at the top of this page. Your continued use of the website after a change constitutes acceptance of the modified Terms.
